Privacy Policy

This is the Privacy Statement of Pedal and Shift Consulting Inc. (hereinafter referred to as PEDAL & SHIFT, “we” “us” or “our”).

This Privacy Statement explains how Personally Identifiable Information (“Information”) is collected, used, shared and protected. This Information is collected when you:

  • Visit our website with your computer, tablet, mobile or other device; or
  • Use an information request form on our website; or
  • Enter into a legally binding contract or agreement with PEDAL & SHIFT; or
  • Engage with PEDAL & SHIFT through other means, not limited to phone or e-mail correspondence.

We also obtain business contact information about professionals working in the sectors we serve from third-party and publicly available sources. Where we do so, the sources are described in “Where we obtain business contact information” below.

All Information is processed in accordance with current privacy legislation. Our legal basis for each kind of processing is set out in “Our legal basis for processing” below.

The Information we collect

PEDAL & SHIFT collects your Information because you make use of our Services, because you provide it to us yourself, or because we have obtained your business contact information from a third-party or publicly available source, as described in the next section.

In addition to the data you share with us directly by using our services, statistical data are collected whenever you visit our website. These data do not contain any personal identifiable information and cannot be connected to individual person(s). The data as collected from a website visitor are for example:

  • Country from which the website is visited (but not the IP-address);
  • The pages that were visited and the duration thereof;
  • Browser type;
  • Operating system;
  • Type of device (like computer, tablet, mobile);
  • Number of returning visits.

Where we obtain business contact information

PEDAL & SHIFT provides business development, strategy, marketing and market entry services to companies in the energy and related sectors. In the course of that work we obtain limited business contact information about professionals whose role is relevant to those services, from the following categories of source:

  • referrals and introductions from clients, colleagues and professional contacts;
  • information published by you or your employer, including company websites, professional profiles, and press and media materials;
  • membership listings and member directories of industry associations and clusters;
  • exhibitor, delegate, speaker and attendee lists for industry conferences and events; and
  • commercial business contact databases.

Information obtained in this way is limited to business contact information — typically name, job title, employer, business email address and business telephone number. We do not seek personal or home contact details from these sources, and we contact people only in their professional capacity.

For what purpose do we process Information?

PEDAL & SHIFT collects and processes Information to help us provide and support our Services, including:

  • to reach out to you to engage regarding our products and services;
  • to deliver goods and services to you;
  • to handle your payment;
  • to provide, improve, test, and monitor the effectiveness of our Services;
  • to diagnose or fix technology problems;
  • to develop and test new services; and
  • to comply with our legal obligations.

Our legal basis for processing

Where you provide Information to us directly, or enter into a contract or agreement with us, we process that Information in order to perform the contract, to take steps at your request before entering into one, or with your consent.

Where we contact you about our services using business contact information obtained as described above, we rely on our legitimate interests in developing business relationships with professionals whose role is relevant to the services we provide. We contact people only in their professional capacity, and only where our services relate to their role. We have assessed the balance between those interests and your rights and freedoms.

Where we send commercial electronic messages to recipients in Canada, we do so in accordance with Canada’s Anti-Spam Legislation, relying on express or implied consent, as applicable.

Your right to stop hearing from us

You can tell us to stop sending you business development or marketing messages at any time, and we will stop. You do not need to give a reason.

Email contact@pedalandshift.com with the word “unsubscribe.” We will action your request without delay and in any event within 10 business days, and we will add your details to a suppression list so that we do not contact you again in error.

How is the collected Information shared?

PEDAL & SHIFT does not sell your Information to third parties and only provides them if necessary for the execution of our agreement with you or to meet a legal obligation.

If we sell or otherwise transfer part or the whole of PEDAL & SHIFT or our assets to another organization, Information collected through the Services may be among the items sold or transferred. The buyer or transferee will be obliged to honour the commitments we have made in this Privacy Statement.

Legal requests and preventing harm

We may access, preserve and share your Information in response to a legal request if we have a good faith belief that the law requires us to do so. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed, and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

How long we keep Information

We keep Information only for as long as we need it for the purposes described above.

  • Business contact information used for business development is reviewed regularly and removed where there has been no engagement and no continuing relevance to our services.
  • Information relating to a client engagement is kept for the duration of the engagement and for seven years afterwards, in order to meet our professional, tax and legal obligations.

Information that is the subject of a legal request or obligation may be kept for longer, as described above.

How we protect personal data

PEDAL & SHIFT takes the protection of your Information seriously and takes appropriate measures to prevent abuse, loss, unauthorised access, unwanted disclosure and unauthorised changes. However, PEDAL & SHIFT cannot ensure the security of any Information you transmit to PEDAL & SHIFT or guarantee that Information on the Services may not be accessed, disclosed, altered or destroyed.

Where your Information is processed

Pedal and Shift Consulting Inc. is based in St. John’s, Newfoundland and Labrador, Canada, and your Information is processed in Canada. We are a commercial organisation subject to Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). The European Commission has determined that PIPEDA provides an adequate level of protection for personal data transferred to organisations subject to it from the European Economic Area — a decision most recently confirmed in January 2024.

Viewing, adjusting or deleting data

You have the right to see, correct or remove your Information. Furthermore, you have the right to withdraw your possible consent for data processing or to object to the processing of your personal data by PEDAL & SHIFT and you have the right to data portability. This means that you can request us to send the personal data we have about you in a computer file to you or another organisation named by you. You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your permission or to object to the processing of your personal data to contact@pedalandshift.com.

If you are not satisfied with how we have handled your Information, you have the right to complain. In Canada, you may complain to the Office of the Privacy Commissioner of Canada. If you are in the European Economic Area or the United Kingdom, you may complain to the data protection authority for the country where you live or work.

Third-party applications, websites and services

PEDAL & SHIFT is not responsible for the practices employed by any applications, websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another application, website or service, our Privacy Statement does not apply to those third-party applications, websites or services. Your browsing and interaction on any third-party application, website or service, including those that have a link on our Services, are subject to that third-party’s own policies.

Changes to this Privacy Statement

We may modify or update our Privacy Statement from time to time. You are advised to review this Privacy Statement regularly for any changes. Changes to this Privacy Statement are effective when they are posted on this page. This Privacy Statement was last updated on 2026/10/06.
